Scope of Application

These General Terms and Conditions of Sale (hereinafter the “GTCS”) apply to all electronic or telephone orders placed by private individuals acting, for personal or professional purposes, as consumers with Circuit du Laquais SAS, either directly on its website accessible at: boutique.circuitdulaquais.com, or by telephone at +33 4 74 54 46 98.

These GTCS may be modified at any time by Circuit du Laquais. It is your responsibility to review and formally accept them before placing any order.

The applicable GTCS are those published on the website on the date of your order and attached to your order confirmation email. Any order placed through the Website implies full, unconditional, and unreserved acceptance of the GTCS in force on the date of said order.

Orders

The following clauses cancel and supersede all printed or handwritten sales clauses appearing in the customer’s correspondence. Placing an order implies express and unconditional acceptance of each of these clauses.

To be valid, any order must be returned together with full payment for the transaction by credit card, bank transfer, cheque, PayPal, or any other payment method made available on the Laquais online store.

The customer must place their order online via our website: boutique.circuitdulaquais.com or by telephone at +33 4 74 54 46 98.

After your order has been placed, Circuit du Laquais will acknowledge receipt by sending an Order Confirmation Email including a summary of your order, its reference number, and these GTCS. Your order will then be definitively validated by an Order Validation Email.

Circuit du Laquais reserves the right not to validate your order for any legitimate reason, particularly in the event that:

  • the order does not comply with these GTCS;
  • one of your previous orders has not been fully paid by the due date;
  • a dispute concerning payment of one of your previous orders is currently being processed;
  • several serious and consistent elements give rise to suspicion of fraud regarding your order.

Gift Voucher Validity and Extension

Only gift vouchers issued by Circuit du Laquais and bearing a specific identification number are recognized as valid gift vouchers. Gift vouchers issued by partners or resellers are excluded.

Gift vouchers issued by Circuit du Laquais SAS are valid for 12 months from the date of issue. Any exchange of services is based on the original value of the gift voucher.

The beneficiary may purchase a validity extension for a maximum period of 3 months. In return, a fee of €39 incl. VAT per gift voucher to be extended shall apply.

Promotions

Promotions displayed on the website are valid only for the purchase of a gift voucher issued by Circuit du Laquais during a specified period and bearing a specific identification number. Offers from partners reselling gift boxes (e.g. Smartbox, Wonderbox, etc.) are excluded from these promotions.

Transfer of Gift Vouchers

Gift vouchers issued by Circuit du Laquais are non-refundable; however, they are transferable and exchangeable to another beneficiary within their validity period.

This transfer may only be requested by the original beneficiary registered with Circuit du Laquais. The transfer request must be made by postal mail and accompanied by a photocopy of the applicant’s national identity card.

Conditions of Access to Services

Track Access

The holder of track access rights must hold a valid driving licence (foreign licences accepted) or a valid FFSA licence recognized by Circuit du Laquais. Probationary licences are accepted. Vehicles must comply with Circuit du Laquais noise regulations. Otherwise, the service cannot be provided.

Karting

Participants must be at least 1.40 m tall and at least 14 years old.

Driving Experiences

The holder of track access rights must hold a valid driving licence (foreign licences accepted) or a valid FFSA licence recognized by Circuit du Laquais. Probationary licences are accepted. All driving experiences sold by Circuit du Laquais include vehicle rental.

Passenger Rides

Participants must be at least 1.40 m tall and at least 10 years old.

The beneficiary must provide all necessary supporting documents on the day of the service upon registration at Circuit du Laquais.

Customer Responsibility

The customer must comply with the safety instructions issued by the organizer and with the internal regulations.

The customer becomes responsible for the vehicles and facilities made available to them as soon as they or one of their guests takes the wheel: the transfer of control of the vehicle implies the transfer of risks.

Consequently, and generally speaking:

  • The customer must use the equipment in accordance with the instructors’ instructions and must not do anything likely to damage it. In the event of dangerous driving, driving errors, or non-compliance with safety rules, the instructor may interrupt the service at any time. The uncompleted part of the service shall not be refundable.
  • The customer must take all useful measures to limit the risks that they or one of their guests may cause.

Circuit du Laquais shall assume material risks during passenger rides and driving experiences.

Alcohol Policy

No tolerance will be accepted. The organizer reserves the right to carry out random breathalyzer tests. If the customer tests positive, the driving experience will be deemed completed and shall not be refunded under any circumstances.

Reservations and Service Dates

Services must be booked with the reservations department, subject to availability, by telephone at +33 4 74 54 46 98, by email at info@circuitdulaquais.com, or via the online pre-booking form:

Any chosen date may be modified up to 15 days before the service date. Beyond this period, the date can no longer be modified and the service shall be deemed completed. Any absence on the scheduled date and time will also result in the service being deemed completed.

Circuit du Laquais reserves the right to postpone dates or modify packages according to availability. If none of the proposed dates are suitable, the participant may later select another available date. However, the booking must be made no later than 9 months after the purchase date, and the service must be completed within 12 months of the purchase date, failing which the voucher shall expire.

Postponement Due to Weather Conditions

Cases of force majeure (particularly weather conditions or vehicle unavailability) may result, at Circuit du Laquais’ discretion, in postponement of the service no later than 2 months after the originally scheduled date (excluding the annual track closure period from 15/12 to 15/02).

Any refusal by the customer shall result in cancellation attributable to the customer, and the service shall then be deemed completed.

Conditions such as snow, ice, temperatures below -2°C, or hail may lead to postponement of the service. If such adverse weather conditions occur during the service, it may be temporarily interrupted and rescheduled later during the day. If the service cannot be completed due to lack of improvement in conditions or lack of time, the uncompleted portion will be postponed.

Any postponement or schedule extension due to force majeure cannot give rise to any claim by the customer, including claims for compensation or price reductions.


Cancellation and Postponement

Any chosen date may be modified up to 15 days before the service date. Beyond this deadline, the date can no longer be modified and the service shall be deemed completed. Any absence on the scheduled date and time will also result in the service being deemed completed.

If the customer fails to comply with the safety instructions issued by the instructors, the service shall be deemed completed and shall not be refunded.

The purchase of the Zen Pack allows the validity period of the driving experience to be extended, provided the request is made no later than 48 hours prior to the scheduled date. The Zen Pack may be used only once. The Zen Pack is priced at €39 incl. VAT when purchased at the same time as the gift voucher. If purchased at a later date, the price shall be €78 incl. VAT, under identical terms and conditions of use.

Right of Withdrawal

French consumer law grants consumers a 14-day withdrawal period for online purchases, allowing reimbursement or exchange of the product. However, Article L.121-20-4 excludes leisure services to be provided on a specific date or according to a specific schedule from the scope of this withdrawal right.

Complaints

Complaints regarding the quality of the service provided must be sent by registered mail no later than 48 hours after completion of the service, failing which they shall be inadmissible.

Such complaints may not justify delayed payment. In the event of a justified complaint acknowledged by Circuit du Laquais, the company’s liability shall be limited to the unperformed portion of the service. No compensation shall be granted for expenses incurred by the customer or for any other reason whatsoever.

Prices

Prices indicated on reservation forms are inclusive of VAT and remain valid for a maximum period of 30 days from the date indicated thereon unless otherwise specified.

Circuit du Laquais reserves the right to modify its prices according to variations in the cost of external services, taxes, or instructors’ salaries.

Payment

Payments may be made by cheque, credit card, bank transfer, PayPal account, or any other payment method available on the online store:

Circuit du Laquais reserves the right to accept the validity of an unpaid order.

Online and telephone payments are processed through a secure payment platform combined with control measures specific to each payment method in order to guarantee transaction security and combat fraud.

Your payment card details never travel unencrypted over the network: they are encrypted using SSL (Secure Socket Layer) protocol.

Delivery

Shipping costs for physical gift vouchers are calculated according to the cost of gift vouchers, gift sleeves, envelopes, and postage.

Electronic gift vouchers in PDF format are sent electronically (email) within 24 hours after order acceptance.

Onboard Video

Circuit du Laquais offers onboard video as an optional extra for driving experiences. The video footage of laps driven or ridden as a passenger is provided to the customer on a USB key at the end of the service.

Video files can be viewed on computers equipped with Windows or Mac operating systems.

The demanding environment inherent to the activity (vibrations, changing light conditions, difficult sound environment, etc.) may cause issues such as:

  • occasional sound interference;
  • video disturbances related to onboard electronics in certain vehicles;
  • recording failures.

Should one or more of these issues occur, or in the event of technical or human error, some videos may not be included on the USB key.

In such cases, complaints will be handled individually according to the following principles:

  • full reimbursement of the USB key purchase price if no video is available;
  • reimbursement of half the USB key purchase price if only one video is available for driving experiences including at least two driving sessions.

No reimbursement will be made if the USB key contains at least two personal videos.

Reimbursements shall be made by cheque or bank transfer within a maximum period of 15 days following receipt of the customer’s bank details or address.

The customer acknowledges that the “Onboard Video” option is an ancillary service and cannot be considered a determining element of the purchase. Failure to provide the USB key does not call into question the actual completion of the driving experience.

During a driving experience, it is prohibited to attach personal onboard cameras (such as GoPro devices) inside or outside the vehicle or on oneself, since onboard video services are offered for sale by Circuit du Laquais.

Liability

Circuit du Laquais shall under no circumstances be held liable for bodily injuries occurring during the services.

Likewise, Circuit du Laquais shall not be held responsible for any physical consequences (e.g. back pain) occurring during or after the service.

Finally, Circuit du Laquais shall not be liable for theft, disappearance, deterioration, or any other damage to objects belonging to the customer or their guests, nor for supervision of children.

Insurance

Circuit du Laquais is insured through Gras Savoye, a Willis Towers Watson company – Motorsports Division – ARS Bât. C1 – Pôle Pixel – 26 Rue Emile Decorps – CS 70120 F – 69628 VILLEURBANNE Cedex, under Professional Multi-risk Policy No. 56.398.416, including in particular the following guarantees:

Motor Insurance

Coverage applies to the financial consequences of the insured party’s civil liability for damage caused to third parties, as well as damage suffered by insured vehicles in connection with professional activities specified in the Special Conditions.

Professional Civil Liability Insurance

Coverage applies to the financial consequences of the insured party’s civil liability for damage caused to third parties in connection with professional activities specified in the Special Conditions.

Property Damage Insurance

The insurer indemnifies the insured against damage suffered by insured property resulting from events covered under the policy.

The customer’s signature, or that of their guest, of these GTCS and the liability waiver on the day of the service limits Circuit du Laquais’ liability to the guarantees mentioned above.

Damage and Deterioration

The customer shall not be held liable for damage to vehicles provided they comply with the safety instructions issued by the instructor.

The customer and their guests remain liable for damage caused to other facilities made available to them.

In the event of an incident resulting from a driving error by the customer or one of their guests, the unperformed portion of the service resulting from said incident shall remain payable by the customer.

Jurisdiction

In the event of disputes relating to the execution of the order, related conditions, or any litigation, the Commercial Court of Vienne, to which our company is attached, shall have sole jurisdiction, even in the event of multiple defendants.

Furthermore, regardless of the customer’s nationality, only French law shall apply.
